What is this document?
A vehicle handover act is a separate legal document that records the exact condition of a vehicle at a specific moment of transfer. It is used in rental, sale, return after rental, issue of a company car to an employee, or return of a leased car to a dealer.
The vehicle handover act describes in detail: existing damage (scratches, dents, cracks), odometer reading, fuel level, completeness (keys, documents, spare tyre, jack). Both parties sign the act, confirming they agree with the described condition.
This is the primary document protecting the car owner from unfounded claims of damage after rental, and protecting the renter from accusations of damage that existed before them.
When do you need it?
A vehicle handover act is needed when:
Starting and ending a rental. Completed at handover to the renter and at return — the two acts are then compared.
Selling a used car between private individuals. Records the condition at the time of sale, protecting the seller from future claims.
Issuing a company car to an employee. Documents the condition in which the car was issued and what is expected at return.
Returning a leased or rented car to a dealer or leasing company. Without a handover act the leasing company can raise claims for any existing damage.
Handing a car over to a garage or detailer. Records the condition before and after servicing.
Common mistakes
Most common mistakes when drafting a vehicle handover act:
Drafting the act without photos. A written description of damage can easily be challenged in court: 'You wrote scratch on bumper, but this is a completely different scratch'. A photo cryptographically embedded in a signed document via Pakto is irrefutable evidence.
Signing the act without inspection in daylight. Fine scratches and dents are invisible under artificial lighting or in shadow. Always inspect the car in daylight.
Not recording the VIN. Without the VIN it is impossible to prove that the act refers to this specific vehicle and not another.
Skipping the odometer reading. Without a recorded mileage it is impossible to prove that the limit was exceeded.
Not checking completeness. Missing key, documents, or spare tyre at return are typical causes of disputes.
What must be included?
- Full names and contact details of both parties
- Make, model, year, colour, and registration number of the vehicle
- VIN — chassis number (mandatory for identification)
- Odometer reading at handover (exact figure)
- Fuel level at handover (percentage or gauge marking)
- List of items included: keys (quantity), registration certificate, insurance policy, service book, spare tyre, jack, wheel wrench
- Detailed description of existing damage with exact location (front bumper left, roof, right rear wing, etc.)
- Photos of the car from all sides and close-ups of existing damage
- Date, exact time, and location of handover
- Signatures of both parties — mandatory
