What is this document?

A car rental agreement between private individuals is a legally binding contract that defines all conditions for using a vehicle for a specified period. Unlike renting from an official company, in P2P rental between private parties this document is the only protection for both sides.

The agreement records: vehicle identification (make, model, VIN, registration number), rental period, price and payment procedure, mileage limit, fuel policy, liability for insurance and damage, security deposit amount and return conditions, list of authorised drivers.

Without a signed agreement the car owner has no legal basis to claim compensation for damage or excess mileage. The renter, in turn, is not protected from unfounded claims for damage they did not cause.

When do you need it?

A car rental agreement between private individuals is needed in the following situations:

P2P rental via platforms or personal arrangements. If you are renting out or renting a car from a private person — through any platform or directly — an agreement is mandatory.

Corporate rental within a small business. When a company rents a car from a private person or rents out its own vehicle.

Temporary transfer of a car to a colleague or relative. Even a short-term transfer without documents can turn into serious problems in the event of an accident.

Long-term rental. If a car is rented for a month or more — a detailed agreement is mandatory.

Common mistakes

Most common mistakes when drafting a car rental agreement:

Not documenting existing damage before the rental begins. This is the most costly mistake. Always walk around the car together in daylight and record every scratch, dent, and crack in the windscreen. Attach photos to the agreement when signing via Pakto — the photo hash cannot be forged.

Vague insurance section. Clearly state: whether the insurance covers the renter, what the excess is, and who pays first. 'We'll sort it out if anything happens' is not a solution.

Not specifying a mileage limit. Without a limit the renter can drive 5,000 km in a week — and you will not be able to prove anything.

Ignoring the fuel policy. Returning the car with a half-empty tank instead of full is a classic dispute. State it precisely.

Signing the agreement without a vehicle handover act. For maximum protection, use both documents: rental agreement + handover act.

What must be included?

  • Full names, dates of birth, and driver's licence numbers of both parties
  • Make, model, year, colour, registration number, and VIN of the vehicle
  • Exact start and end date and time of the rental
  • Odometer reading at handover and return
  • Agreed daily or total mileage limit and cost per additional kilometre
  • Fuel level at handover and return conditions (full tank / same level / monetary compensation)
  • Insurance details: whether the owner's insurance covers the renter, excess amount, who pays in the event of an accident
  • List of authorised drivers (other than the main renter)
  • Deposit amount and clear conditions for its return or retention
  • Detailed list of existing damage with location noted
  • Photos of the car from all sides, attached to the agreement
  • Signatures of both parties with date and time

Frequently asked questions

Is a digital car rental agreement between private individuals legally valid?

Yes. Under eIDAS Art. 26, an advanced electronic signature is equivalent to a handwritten one in all EU countries. Pakto includes an RFC 3161 TSA timestamp and a verified signatory identifier, allowing both parties to be unambiguously identified in the event of a dispute.

Can photos of the car be attached to the agreement at signing?

Yes, and this is strongly recommended. Pakto allows photos to be attached during signing. The SHA-256 hash of each photo is embedded in the cryptographic signature — the photo cannot be changed or substituted after signing. This is the most effective protection against unfounded damage claims.

What to do if the car is returned with new damage?

Compare the signed handover act and attached photos with the current condition of the car. A digitally signed document via Pakto with embedded photo hashes is irrefutable evidence: it clearly shows which damage existed before the rental and which appeared afterwards.

Is a separate vehicle handover act needed in addition to the agreement?

For maximum protection — yes. The rental agreement establishes the legal terms (price, period, liability). The handover act records the physical condition of the car at a specific moment at handover and return. Most experienced owners use both documents.

What if the renter has an accident?

The rental agreement clearly defines who bears liability and to what extent. Without an agreement, establishing liability is much more difficult. Having a signed agreement with a TSA timestamp is a mandatory requirement of insurance companies and the police when filing an accident report.
