What is this document?

A work acceptance certificate is a bilateral legal document by which the client officially confirms that the contractor has delivered the work in accordance with the terms of the contract. Signing the certificate records the official moment of handover of the work results and is the basis for final or staged payment.

Work acceptance certificates are used in construction, renovation, IT development, design, consulting, equipment installation, and any other contracting relationship. It is a mandatory supplement to a contract for work or services.

Without a signed certificate, the contractor has no documentary confirmation that the work was delivered and accepted. The client, in turn, has no right to demand correction of defects discovered after signing if they signed 'without objections'.

When do you need it?

A work acceptance certificate is needed:

Upon completion of any contracted work. Construction, apartment renovation, equipment installation, IT development, design, cleaning — any completed scope of work requires an acceptance certificate.

For staged delivery of large projects. Each stage is closed with a separate certificate and a separate payment.

When a freelancer or contractor delivers interim results. Each delivery — a separate certificate.

To start the warranty period. In most countries the warranty period begins from the date the acceptance certificate is signed.

Common mistakes

Most common mistakes when drafting a work acceptance certificate:

Signing the certificate without actually checking the work. By signing 'without objections', the client effectively waives the right to demand correction of visible defects. Never sign the certificate without personally checking the work.

Vague description of completed work. 'Room renovation' means nothing. Correct: a specific list with references to contract clauses and measured results.

Not recording identified defects. If there are objections — include them in the certificate before signing, with a clear deadline for resolution. A signed certificate with objections protects both parties better than a refusal to sign.

Ignoring staged delivery. On large projects without staged certificates it is hard to track what has already been accepted and what is still in progress.

Backdating the certificate. The TSA timestamp in Pakto makes the signing date indisputable — this protects both parties from date manipulation.

What must be included?

  • Full names and details of both client and contractor
  • Reference to the original contract: number and date of conclusion
  • Detailed description of the work completed with a specific list
  • Scope and result: area (m²), number of units, functionality, etc.
  • Total value of the completed work payable
  • Explicit confirmation of acceptance: 'the work has been completed in full and in accordance with the contract'
  • Identified defects or objections (if any) and agreed deadline for their resolution
  • Date of actual acceptance of the work
  • Signatures of both parties — mandatory

By signing the certificate, am I waiving my right to demand correction of defects?

Partially — regarding visible defects, if you signed 'without objections'. Hidden defects that appear after signing can be required to be corrected within the warranty period. If there are objections — include them in the certificate before signing.

Is a digital acceptance certificate valid for construction contracts?

Yes, in most EU countries. An electronically signed document under eIDAS Art. 26 is admissible in court and binding for commercial contracts. For large construction projects with public funding, check the specific national regulations.

What if the contractor refuses to sign the certificate?

A contractor's refusal usually means a dispute over payment or incomplete work. Immediately document the refusal in writing and state what specifically has not been completed in accordance with the original contract. This record will serve as evidence in court.

Can a partial certificate be signed for one stage?

Yes. Staged acceptance is standard practice in construction and IT. Each certificate covers a specific scope and triggers the corresponding payment. Pakto allows separate documents to be created for each stage with full timestamps.

How to protect yourself if defects are discovered after signing?

For hidden defects (those that could not be detected during a normal inspection) the warranty period is usually 1–5 years depending on the type of work and country. Immediately notify the contractor in writing with a detailed description and photos.
